Transactional and Project Advice:
Transactions and investments to which sovereign entities are parties,
including the Privatization of State-owned Enterprises, Infrastructure
Development Programs, Project Financing, and Debt Restructuring, raise
important issues of international law like how disputes will be settled,
guarantees honored and contracts enforced. We advise sovereigns and
private entities regarding the existence of sovereign immunity from
jurisdiction, a fair dispute resolution procedure and suitable forum, and
drafting dispute resolution agreements.
Treaty Negotiations:
We offer advise to our clients on the potential ramifications of, and
rights available under, international conventions such as the New York
Convention on the Recognition and Enforcement of Foreign Arbitral Awards,
the Convention on the Settlement of Investment Disputes between States and
Nationals of Other States, the Convention Establishing the Multilateral
Investment Guarantee Agency, and the Marrakech Agreement Establishing the
World Trade Organization. We analyze the implications of existing
treaties as well as treaties being proposed or negotiated. We also advise on the
interpretation of treaties and international agreements including North
American Free Trade Agreement, the United Nations Convention on the Law of
the Sea, and the Dispute Settlement Understanding of the WTO.
Preparation of Claims: We assist clients in
establishing the validity of claims or defend against claims in various
forums, courts and tribunals established under international law.
Special Issues:
We address specific issues under international law, such as the likelihood
of success of a claim, State's adherence
to certain obligations, breaching of an international agreement, interpretation of the decisions of a particular international court
or tribunal, and appropriate method of valuing expropriated
property.
Litigation or Arbitration:
We assists clients involved in disputes to reach amicable settlements.
We represent clients before the International Court of Justice in The Hague and in
other forums including specialized courts and tribunals as well as
arbitral tribunals.
